What to include in a notice
- Your physical or electronic signature
- A description of the copyrighted work you believe was infringed
- The address (URL) of the page with the material, and a description of it, so we can find it
- Your name, mailing address, phone number and email
- A statement that you believe in good faith the use is not authorized by the copyright owner, its agent or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner
What we do
When we receive a complete notice, we remove or disable access to the material and tell the person who provided it, if we can. Notices about MLS listing content (listing details and photos) are also forwarded within 24 hours to MIAMI REALTORS®, which supplies that content, as their DMCA policy requires.
Counter-notice
If you believe material you provided was removed by mistake, you can send a counter-notice to the designated agent with: your physical or electronic signature; a description of the material and where it appeared before removal; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your name, address and phone number, with a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the United States, any district where we may be found) and will accept service from the person who sent the original notice. We may restore the material in 10 to 14 business days unless the original sender tells us they have filed a court action.
Repeat infringers
We will remove content from, and stop working with, anyone who repeatedly infringes copyrights.
